On November 12, 2013 University Heights City Council adopted their Title VI Non Discrimination Policy.
A formal complaint of alleged discrimination in federally assisted programs or activities must be filed within 180 calendar days of one of the following:
(a) The alleged act of discrimination,
(b) Date when the person(s) became aware of the alleged discrimination, or
(c) Date on which the conduct was discontinued, if there has been a continuing course of conduct.
As a condition of receiving federal financial assistance from the Federal Highway Administration, the Iowa Department of Transportation (Iowa DOT) is required to establish and implement a Title VI program that ensures nondiscrimination in its programs, services and activities. Iowa DOT carries out the mission of the federal aid programs and must comply with all nondiscriminatory and equal opportunity statutes, regulations, and executive orders that apply to the distribution of federal funds. Additionally, recipients and sub-recipients receiving federal funds must adhere to the regulations set out by 23 CFR and 49 CFR, which are the regulations for Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, Title IX of the Education Amendments of 1972, the Age Discrimination Act of 1975, and a variety of program-specific statutes with nondiscrimination requirements.
The Iowa DOT requires the City to adopt a non-discrimination policy; to make certain non-discrimination assurances; and to enter into a non-discrimination agreement with Iowa DOT. The formal adoption of these Title VI documents provide Iowa DOT with the appropriate assurances that will keep University Heights eligible for future federal financial assistance. These documents also provide a framework of procedures for the City of University Heights to appropriately handle discrimination complaints relating to federally assisted transportation-related programs or activities.
